4. Disclaimers, Limitation of Liability, and Indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOTIK AI’S AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING FROM THESE TERMS OR YOUR USE OF THE SITE OR SERVICES IS LIMITED TO THE FEES PAID BY YOU TO KOTIK AI IN THE PRIOR TWELVE MONTHS, IF ANY. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS KOTIK LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND CONTRACTORS FROM CLAIMS ARISING OUT OF YOUR USE OF THE SITE, YOUR VIOLATION OF THESE TERMS, OR YOUR INFRINGEMENT OF THIRD-PARTY RIGHTS. NOTHING IN THESE TERMS LIMITS LIABILITY FOR BODILY INJURY OR DEATH CAUSED BY NEGLIGENCE WHERE SUCH LIMITATIONS ARE UNENFORCEABLE UNDER APPLICABLE LAW.
5. Termination, Changes, and Governing Law
